RITTENHOUSE. Martha and William were under the age of 25 yers so their share was not to be paid to them until they reached 25 year old but they could have the interest from their share of the capital. All the residue and all personal property was bequeathed to her husband GEORGE R. RITTENHOUSE and he was appointed the Executor. There is no inventory with the file so we can't tell the value of the estate

A copy of this file is held by the Montgomery County Archive in Norristown, Pa. even though the Will was filed in Baltimore, Maryland, It is File RW 5673.

GEORGE RAZER RITTENHOUSE wrote his Will on14 January 1887 but it wasn't being probated until 2 July 1890, so he must have died during that time period. His wife TABATHA POTTS had predeceased him dying in 1885. They lived at # 1316 Lexington Street in Baltimore, Maryland.

He asked his daughter ANNE G. RITTENHOUSE to keep his property together for at least 3 years in order to maintain a home for the other children who were younger than ANNE. This request would also include the stables on Bethany Lane and all the household furniture. When the property was finally sold, the proceeds were bequeathed as follow. Daughter KATE POTTS RITTENHOUSE was to receive $500. The balance was to be divided equally among the 5 children, ANNE G., KATE P., MAY, MARTHA W. and WILLIAM P. RITTENHOUSE. As WILLIAM was a minor, ANNE was to invest his share until he became of age.

GEORGE asked that only enough of his stocks and bonds be sold to look after debts and funeral expenses. They were to be divided as equally as possible among the 5 children. The daughter ANNE was appointed Executrix of the estate but in case of her death before his own, then daughter KATE would be the Executrix.

His brother NICHOLAS RITTENHOUSE and step-brother VAN BRANT RITTENHOUSE were witnesses to the Will along with Henry Garey.

The Will is # RW5339 and is held by the Montgomery County Archives in Norristown, Pa.

  476. JAMES8 RITTENHOUSE (NICHOLAS DETWEILER7, MARTIN6, NICHOLAS5, WILLIAM DEWEES4, NICHOLAS (CLAES)3, WILHELM2 RÜDDINGHUYSEN, CLAES1 RETTINGHAUSEN) (#24616) was born in Roxborough Twp, Phil. Co., PA 1803. JAMES died before 23 July 1862 in Pottstown, Montgomery Co., Pa., at age 59.

He married LUCINDA TREXLER date unknown. (LUCINDA TREXLER is #25031.) LUCINDA was born 1809. LUCINDA was the daughter of REUBEN TREXLER and ANNA LESHER. LUCINDA died 04 January 1887 in Pottstown, Montgomery Co., Pa., at age 77.

LUCINDA TREXLER, widow of JAMES RITTENHOUSE, was living in Pottstown, Montgomery County, Pa. in 1870. Her daughter ANNIE, age 26, was living with her. LUCINDA had a very large evaluation of her real estate at $40,000 and personal property which would include investments at $121,700. Shown in Montgomery County 1870 census Roll 1378 Book 1 Page 322.

LUCINDA TREXLER made her Will on 18 October 1876 but did not actually die until 4 January 1887. She appointed her daughter ANNIE and husband MILLER EVANS as Executors of the estate. She bequeathed $700 to the Church of the Transfiguration and $300 to the Pottstown Cemetery Company for the care of her cemetery plot. She bequeathed the bank stock in the National Bank of Pottstown to her granddaughter LUCIE R. EVANS. All the residue of the estate was to go to her daughter ANNIE R. EVANS.

There is no distribution shown in these files so it is not possible to tell the value of this bequest but we know it must have been considerable from the information shown earlier. LUCINDA TREXLER RITTENHOUSE had 4 other children, KATE, CAROLINE, HORATIO and CARRIE. They are absent from their mother's Will which is curious unless there had been some breakup of family relations.

This Will is file RW 5524 and is held by the Montgomery County Archives in Norristown, Pa.

       SOURCE of INFORMATION

HISTORY of the RITTENHOUSE FAMILY by Daniel K. Kolb published 1894 in Germantown, Philadelphia, Pa. This is one of the several books and pamphlets published by Daniel K. Kolb.

JAMES RITTENHOUSE was living in Pottstown, Montgomery County, Pa. in 1860. His wife is LUCINDA TREXLER, age 50 and they have 1 daughter, ANNIA L. age 16 who was born in Maryland, USA. There is no occupation shown for JAMES but his holdings in real estate are valued at $99,400. and personal goods at $5,300. This is a huge fortune in 1860 but there is no mistake as after his death his widow passes on even more to the daughter ANNIE L. RITTENHOUSE. Found in Montgomery County 1860 Census Roll 1144 Book 1 Page 789.

An explanation for the large holdings of JAMES RITTENHOUSE is contained in the probate of his estate after he died in 1862, He had owned 224 acres of land in Pottsgrove Township, Montgomery County, Pa. He had a house (messuage) but also owned the Glasgow Forge. This term was used for the smelting of a commercial iron mine and not just a blacksmith forge.

JAMES RITTENHOUSE wrote his Will on 12 July 1862 and it was probated on 23 July 1862 so his actual death must have been between those dates. He left his entire estate to his wife LUCINDA TREXLER, for her use during the rest of her natural life. On her decease it was to go to their daughter ANNIE L. RITTENHOUSE. Evidently the daughter was not yet of age as the Will stipulated that if she should die without issue, then the residue of the estate should be divided into 4 equal shares. One share should go to CAROLINE SCHALL, wife of WILLIAM SCHALL. what relation these were to JAMES RITTENHOUSE, we don't know. The other 3 shares were to be divided equally between the children of the bothers of JAMES. These were NICHOLAS, GEORGE and MARTIN.

JAMES directed his Executors to sell at public auction any part of the estate sufficient to pay off his debts. JAMES HILTON purchased part of this property for $18,000 at the auction. He appointed his wife LUCINDA guardian of their daughter ANNIE L. RITTENHOUSE. The Executors he appointed were his wife LUCINDA, his brother NICHOLAS and ALEXANDER VAN BUSKIN.

They returned an inventory of $30,571.04 on 28 October 1865. However there was a $2772 mortgage to be paid off plus $841.38 of expenses.

The files are Orphan's Court OC 15,616 and Will File RW 5463 and they are held by the Montgomery County Archives in Norristown, Pa.

NICHOLAS RITTENHOUSE went into business with his father NICHOLAS and his brother MARTIN at Grove Mills on the Wissahickon Creek where he learned the flour milling trade. In 1857 the old mill was razed and a new woolen mill built.

The 1860 Census identifies this area as Philadlphia Ward 21. NICHOLAS, age 52 is shown as a miller with large holdings. The mill and land was valued at $39,000 and personal goods at $18,600. His wife SARAH POTTS had died in 1855 but 5 of his children were still living with him. ENOCH W. age 20, ANNA S. 18, MARTHA P. 16, NICHOLAS M. 14 and ELIZABETH age 12. The ENOCH W. mentioned above is the second son of that same name. The first ENOCH W. died in 1839, just 14 months old.

The 1870 census for Philadelphia County shows NICHOLAS (NICK) RITTENHOUSE living alone with his daughter ANNA age 27. His wife SARAH POTTS died in 1854.. His real estate was valued at $65,000 so it must have included the mill mentioned above. His personal property was also extensive and was valued at $30,000 Census Roll 1409 Book 1 page 436.

       Obituary of NICHOLAS RITTENHOUSE

Nicholas Rittenhouse was well known throughout the Twenty-first and Twenty-second wards; died Friday morning at his residence, on Ridge Avenue above Jefferson Street, Roxborough, in his 84th year. His death is ascribed to heart trouble and dropsy, with which he had been ailing for some time past. Mr. Rittenhouse was a descendant of one of the oldest American families, his ancestors coming from Holland. They may have made a short stay at New York, then called New Amsterdam, and came to Pennsylvania afterwards and settled at Germantown in 1688. They. were William, two sons and a daughter. Nicholas Rittenhouse, the deceased, was born at the old homestead near the Wissahickon, October 20, 1806, received his education in the Germantown Academy, to the building of which his grandfather, Martin, contributed. He subsequently learned the business of miller with his father, and from 1828 to 1857 carried on the flour business at the mill known as Grove Mills, on the Wissahickon, with his brother, Martin, under the firm name of Martin & N. Rittenhouse. In 1857 he razed the old mill and erected on its site a woolen mill, which was subsequently torn down by the Fairmount Park Commission.

Deceased was for many years a member of the Board of Directors of the National Bank of Germantown, and of the Mutual Fire Association of Germantown. He was a Presidential Elector for General W. H. Harrison in 1840, and was one of a committee of citizens who received President Lincoln on his visit to Philadelphia after his election in 1860. The deceased is the last of his generation in his family, his brother George B., having died in Baltimore several weeks ago. The funeral took place on Monday afternoon. Burial services of a very impressive character were held at his late home before the funeral procession moved. Rev. J. Wallace Kirk, of the Roxborough. Presbyterian Church, and Rev. J. W. Willmuth, of the Baptist Church, officiated. The remains were interred in the Mennonite Cemetery, on Main Street, Germantown.

The pallbearers were William Conway, Joseph Fogg, Walter Conway and William O'Brian. Children: Enoch lst, Enoch 2d, Anna, Martha, Elizabeth, William, Nicholas, Mary and Sallie. Germantown Telegraph.

He married SARAH M. CHESNEY before 1835. (SARAH M. CHESNEY is #25038.) SARAH was born 1813. She married UNKNOWN MCBURNEY date unknown. SARAH died after 1860 at age unknown.

JOSIAH RITTENHOUSE and SARAH M. CHESNEY had the following children:

                   i.  NICHOLAS9 (#25040). NICHOLAS died after 21 April 1858 in Line Lexington, Bucks Co. Pa., at age unknown.

NICHOLAS RITTENHOUSE resided and farmed near Line Lexington, Bucks County, Pa. He never married. He wrote his Will on 21 April 1858. He stipulated that his Executor was to pocure suitable head and foot stones for his father's grave. His father was JOSIAH RITTENHOUSE and his mother was SARAH CHESNEY. He bequeathed $1,000 to CATHARINE DOUGHERTY who had been living with his grandfather's family at the time of his death. His grandfather was NICHOLAS DETWEILER RITTENHOUSE. He directed that all his real estate be sold and the residue of his estate was to be divided between DANIEL UMSTEAD and JOSIAH R. UMSTEAD, both sons of WILLIAM and his wife MARIA. NICHOLAS appointed FRANCIS HARTMAN and OLIVER FRICK as the Executors.

All that should have been simple enough but on 9 November 1858, his mother SARAH CHESNEY (remarried to an UNKNOWN McBURNEY after the father JOSIAH died), filed a Caveat with the Court to claim the Will as not being valid and to block any Administration Papers to distribute the estate.

She based this Caveat on 5 points and it was accepted by the Court for investigation on 18 December 1858. Here is the complete Caveat.

1. Because the decedent at the time of his death was domiciled in Philadelphia County and not in Bucks County. (where the Will had been filed.)

2. Because the principal parts of the goods and estate of the decedent was at the time of his death, and still is, in Philadelphia County.

3. Because the alleged execution of the said paper was induced and procured by undue and improper influence.

4. Because at the time of the alleged execution of the said paper, the said decedent was not mentally competent to execute a valid will.

5 Because the said paper is not the last Will and Testament of the said Nicholas Rittenhouse.

The Philadelphia Court of Common Pleas heard all the witnesses and filed their ruling on 1 January 1859. The witnesses included doctors, friends and neighbours and the testimony filled about 20 pages. Their verdict on the first 2 points of the Caveat was to refute the statements that NICHOLAS RITTENHOUSE had been living in Philadelphia and had his goods there at the time of his death. This meant the filing of the Will in Bucks County was correct and therefore the Philadelphia Court turned everything over to the Bucks County Court of Common Pleas to decide whether the Will was authentic.

Once this was admitted to the Bucks County Court, the original filing in this jurisdiction was then legal as originally filed and the roles were reversed. The original Executors, FRANCIS HARTMAN and OLIVER FRICK, were considered the plaintiff and SARAH CHESNEY, the defendant. Once again there were many witnesses called and filled many pages of Administration Papers. In the Court hearing on 8 May 1860 it went before a jury of "12 good men and true". and the final decision was that the Will was authentic and therefore the original Executors of FRANCIS HARTMAN and OLIVER FRICK were told to proceed with administering the estate and file a final inventory

Part of the estate comprised the legal right NICHOLS had in the estate of his grandfather NICHOLAS DETWEILER RITTENHOUSE who had died the year before. This amounted to $4,000. The proceeds on the sale of the house in Line Lexington were $3,000. The total value of the estate was $13,218.55. However there were debts of $1,062.84 to be paid out of this. As the Will was declared perfectly legal, SARAH CHESNEY, his mother, did not receive any proceeds whatsoever from the estate. We will never know what caused this family dispute in the first place.

This huge and complicated file is Will #10,368, Will Book 15, Page105 and is held by the Bucks County Archives in Doylestown, Pa.

SARAH RAUDENBUSH, widow of HENRY REINER RITTENHOUSE, made her will on 26 May 1881 but her actual death wasn't until 18 May 1887. In her Will she bequeathed $100 to her grandson HENRY R. RITTENHOUSE, the son of CHARLES RITTENHOUSE. She left $100 to St. Luke's Reformed Church in Trappe, Montgomery County, Pa. All the residue of her estate was left to "my beloved friend HARRIET RAMBO, wife of MILTON RAMBO of Lower Providence Township," She appointed Daniel Latshaw of Royersford, as Executor of her estate.        The Executor Daniel Latshaw died so SARAH appointed Milton Rambo as Executor. in a codicil she filed on 27 January 1887. When he filed an inventory return on 9 July 1887, the estate was valued at $2.299.58. However by the time debts and expenses were deducted, the net estate was $1.699.58. By this date there was an Estate Tax in effect. This amounted to $84.98.

This Will file is RW 35654 and is held by the Montgomery County Archives in Norristown, Pa.

HENRY REINER RITTENHOUSE, on 10 April 1841, filed a petition with the Orphan's Court to have a guardian appointed for their 2 minor children under the age of 14 years. They were CHARLES AUGUSTUS RITTENHOUSE and MARY MAGDALENE RITTENHOUSE. Orphan's Court File OC 15,124.

The above may have happened after the death of HENRY's first wife whose family name is possibly confused. Daniel Kolb Cassel in his book published in 1894 titled the Rittenhouse Family, states "these two children Mary M. and Charles A. were by the first wife, Miss Wismer Rittenhouse." It is impossible to tell whether he meant Rittenhouse as her maiden name or her married name.

HENRY REINER RITTENHOUSE was farming in Upper Providence Township, Montgomery County, Pa. in 1850. His farm was appraised at $5,000. With him was his wife SARAH RAUDENBUSH and the 2 children, MARY 18 and CHARLES 16 who were children of his first wife. Found in Montgomery County 1850 Census Roll 799 Book 1 Page 294.

HENRY, age 52, was still farming in Upper Providence Township, Montgomery County, Pa. in 1860. His wife SARAH RAUDENBUSH, age 57, as well as 2 girls are living on the farm. One is HENRIETTA BROWER (?) age 16 and the other is ELIZABETH DEEM (?) age 18 but we don't know their relationship. The 2 children CHARLES and MARY had evidently left home. Found in Montgomery County 1860 Census Roll 1145 Book 1 page 607.

By 1870 HENRY and his wife SARAH were still farming in the same location. The 1877 Montgomery County Historical Atlas shows their farm just south of Freeland. Their farm is valued at $15,000 and their personal goods at $5,000. So in the 20 years they had enlarged and improved their property extensively. They needed 3 hired hands to help on the farm. Found in Montgomery County 1870 Census Roll 1379 Book 1 Page 378.

HENRY REINER RITTENHOUSE wrote his will on 22 July 1878 and died 7 weeks later on 14 September 1878. He bequeathed to his wife, SARAH RAUDENBUSH, all the household furnishings she needed and also $300 in cash.. He then directed his Executors to place $6,000 in a trust fund, with the interest being paid to SARAH. He left $500 to HARRIET RAMBO, wife of MILTON RAMBO.

To equalize the amounts going to his children, he left $1.200 to his daughter MARY, wife of ABEL THOMAS. The balance of his estate was to be invested in a trust fund, with the interest being paid to his son CHARLES for the balance of his natural life. Evidently he didn't entirely trust CHARLES to use this money wisely. He had a clause stating that if CHARLES did not use the money for the benefit of his family, the Executors were to pay the interest directly to CHARLES wife. He appointed his son-in-law ABEL THOMAS and HENRY W. KRATZ as Executors.

By law at that date a widow was entitled to choose $300 value from her husband's goods, before the distribution of the estate. SARAH did this and on 2 June 1879 listed what she would keep. These lists are interesting as they disclose what was important to a housewife, such as the kitchen equipment, beds, cupboards and carpets. But in the case of SARAH she also kept 2 swarms of bees.

When the Executors took the inventory on 2 October 1878, the value was $28,878.80.This included 40 acres of mill property in Upper Providence Township, Montgomery County, Pa. valued at $4,800. Also the 100 acre farm in the same township, valued at $12,000. So the widow, SARAH, and son CHARLES, would receive the interest from the trust funds. SARAH died in 1887. CHARLES married MARY CROLL and they had 5 children so presumably if the Executors thought he was spending his money wisely for his family, CHARLES would continue to receive the interest from his father's estate until he himself died.

However from other Orphan's Court documents. File OC #16,062, settling the estate of ABEL THOMAS, husband of MARY RITTENHOUSE, it mentions a dower right of SARAH, widow of HENRY R. RITTENHOUSE, of Upper Providence Township, Montgomery County, Pa. We know that SARAH was to receive the interest of a dower charge of $3,333.33. This point had arisen because Abel Thomas had left land to his daughter Matilda Thomas Culp and this dower charge had not been cleared by the Courts and was therefore still outstanding. The auditor for the Thomas estate declared it would have to be paid before the estate could be settled.

The files for HENRY REINER RITTENHOUSE are Will RW #5361 and Orphan's Court File OC #15,385. They are both held by the Montgomery County Archives in Norristown, Pa.

HENRY REINER RITTENHOUSE and UNKNOWN WISMER had the following children:

      1096      i.  MARY MAGDALENE9 was born 1831

1097 ii.  CHARLES AUGUSTUS was born 1832

  486. DAVID REINER8 RITTENHOUSE (JACOB DETWEILER7, MARTIN6, NICHOLAS5, WILLIAM DEWEES4, NICHOLAS (CLAES)3, WILHELM2 RÜDDINGHUYSEN, CLAES1 RETTINGHAUSEN) (#25051) was born in Roxborough Twp, Phil. Co., PA 17 January 1809. DAVID died 06 October 1876 in U. Prov. Twp, Montgomery Co. PA, at age 67.

He married twice. He married ANN JOHNSON date unknown. (ANN JOHNSON is #25052.) ANN was born 1833. ANN died 18 April 1919 in U. Prov. Twp, Montgomery Co. PA, at age 85.

DAVID RITTENHOUSE was dead by the time of the 1880 census for Upper Providence Township, Montgomery County, Pa. It shows ANN RAUDENBUSH, his widow, running the farm with the help of her children. The location was explained in the biographical notes for DAVID. The children were MARY 22, HENRY 15, DAVID 13, EMMA 12, JACOB 10 and SAMUEL 6 born less than 2 years before his father DAVID died. Found in Montgomery County 1880 census Roll 1159 Book 1 Page 164.

There are very seldom any dates on the Petitions to the Court to appoint guardians for minor children. However in this case the ages of the children are mentioned so we can figure it was made in 1878/9, The petition was made by their mother ANN RAUDENBUSH for DAVID 12, EMMA 10, JACOB 8 and SAMUEL 3 years old. As usual in these petitions they ask the Court to appoint a guardian to protect their interests. They are all minor children under the age of 14 so the surviving parent has to make the petition. Orphan's Court File OC #15,100.

By 1900 ANN was running this very large farm and all the children were still with her. Amazingly none of them have married and yet MARY is 43, HENRY 35, DAVID 33, JACOB 30 and SAMUEL 26. Found in Montgomery county 1900 census Roll 1444 Book 2 Page 245.

In 1910 ANN was still operating the farm in Upper Providence Township. Her son JACOB was married to STELLA in 1902 so he was no longer around to help. However 4 of ANN's adult children were still living with her. But with JACOB gone it became necessary to hire a farm helper and this was George Harris. It shows on the 1900 and 1910 census that ANN and David Rittenhouse had another 3 children who died either at childbirth or very young as they were not named on any census. Found on Montgomery County 1910 census Roll 1380 Book 1 Page 25.

ANN RAUDENBUSH, widow of DAVID RITTENHOUSE, died Intestate on 18 April 1918. As mentioned above she still owned a very large farm as well as some investments. Two of her sons, HENRY and DAVID, were appointed as Administrators of the estate. They filed an inventory on 3 July 1919, totalling $23,832.68. Of this amount $9900 covered the valuation of a farm propery ANN had purchased in 1897. It was 97 acres in Limerick Township, Montgomery County, Pa.

By this date the government had legislated Inheritance Tax. The appraisers for the government immediately filed an appeal stating the valuation for tax purposes should have been $23,853.88 and NOT $7,950.89 as the Administrators had filed. The Orphan's Court appointed an appraiser of their own and filed a petition on 3 September 1919 with the Court, pointing out all the mistakes the Administrators had made in their appraisal. Some of this centred around the property in Limerick which the Administrators had ignored in their original filing.

That was the beginning of a long legal battle. JACOB, one of the sons and a legatee, asked the Court to release whatever they thought fair and he would settle for that amount as his share. He wanted to buy a house and needed the money to do that. In the end the Judge of the 38th Pennsylvania Judicial District ruled the government had no right to appeal in the first place and dismissed the case. There is no final distribution detail in this file so we don't know what amount each of the children received. All living children would have an equal right to share in the estate.

These huge files are RW # 33,837 and OC #32,231. They are both held by the Montgomery County Archives in Norristown, Pa.

He married ANN RAUDENBUSH date unknown. (ANN RAUDENBUSH is #38260.)

DAVID RITTENHOUSE was farming in Upper Providence Township, Montgomery County, Pa. in 1850. His farm was appraised at $5.000. Living with him on the farm were his brothers MARTIN 39, JACOB 31 SAMUEL 18, sister RACHEL 20 and their widowed mother MARY REINER. Found in Montgomery County 1850 census Roll 799 Book 1 Page 292.

By 1870 DAVID was still farming on the same land but it was much enlarged and improved. It was located south of Trappe and on the border of Upper Providence and Limerick Townships. It was valued at $10,000 and his personal goods at $2,500. But about 1856 he married ANN JOHNSON who was only 24 and DAVID was 49. One record says his wife was, ANN RAUDENBUSH, but whether this was a first wife or a mixup in the family name we don't know. The 6 children DAVID nd ANN JOHNSON had since their marriage were MARY 12, ANN 8, HENRY 5, DAVID 3, EMMA 2 and JACOB only 2 months old. DAVID'S widowed mother MARY REINER, age 85 was also living with them. Shown in Montgomeery County 1870 census Roll 1379 Book 1 Page 375.

DAVID RITTENHOUSE died on 6 October 1876. His widow ANN JOHNSON filed a petition with the Orphan's Court on behalf of her 4 minor children who were under the age of 14 years, to have a guardian appointed to protect their interest in any estate left by the deceased father. When children were under the age of 14 a parent had to petition on their behalf whereas if they were over 14 they petitioned on their own. The children were DAVID 12, EMMA 10, JACOB 5 and SAMUEL 8. This petition is file # 0C 15,100 in the Orphan's Court and is held by the Montgomery County Archives in Norristown, Pa.

The Court appointed the widow, ANN JOHNSON, and DAVID's brother, HENRY REINER RITTENHOUSE, Executors of the deceased DAVID's estate. By law the widow could choose up to $300 value of goods before the estate was settled. She chose some goods but elected to take $248,90 in cash on 2 November 1876. This is the first time I have come across the Court allowing the widow to take part cash as her legal right. She usually had to wait until the estate is settled to see whether there is any cash left after the epenses and debts are paid.

In the meantime HENRY REINER RITTENHOUSE died so a new Executor had to be appointed which was HENRY KRATZ who was the Executor appointed by HENRY REINER RITTENHOUSE in his will. When they took the inventory it totalled $1,572.28. However the debts and expenses totalled $1,824.02 so the estate was declared insolvent. That meant there was no money left for the widow and children so maybe ANN JOHNSON was clever in taking some cash as part of her $300 widow exemption. This is all found in Orphan's Court File OC 15,099 and Will File RW 15,063 and they are held by the Montgomery County Archives in Norristown, Pa.

DAVID REINER RITTENHOUSE and ANN JOHNSON had the following children:

                   i.  LIZZIE9 (#30730) was born in U. Prov. Twp, Montgomery Co. PA. LIZZIE died before 19 December 1954 at age unknown.

          1098 ii.  SAMUEL.

iii.  MARY (#25216) was born in U. Prov. Twp, Montgomery Co. PA 1859. MARY died before 20 March 1953 in U. Prov. Twp, Montgomery Co. PA, at age 93.

MARY RITTENHOUSE, age 20, and her brother HENRY, age 14, filed a petition with the Orphan's Court of Montgomery County, Pa. in 1878. In part it read "respectfully represent that they have no person legally authorized to take charge of their estate and ask permission to choose some suitable person for that purpose." In Pennsylvania if one of the parents died, the Court would appoint a guardian to protect the interests of the children. If they were under 14 years, this guardian would be appointed by the Court. If they were over 14 years old they could ask the Court if they could choose their guardian who would still have to be approved by the Court.

MARY RITTENHOUSE was living on a dairy farm in Upper Providence Township, Montgomery County, Pa. She had never married and in 1930 was living on the farm with her brothers DAVID and HENRY and sister EMMA. 1930 census Roll 2085 Book 1 Page 191.

iv.  ANNA (#26968) was born in U. Prov. Twp, Montgomery Co. PA 1862. ANNA died before 19 December 1954 at age 92.

                  v.  HENRY (#25217) was born in U. Prov. Twp, Montgomery Co. PA 1865. HENRY died 22 January 1939 in U. Prov. Twp, Montgomery Co. PA, at age 73.

HENRY RITTENHOUSE, age 14, and his sister MARY, age 20, filed a petition with the Orphan's Court of Montgomery County, Pa. If they were over 14 years old they could ask the Court if they could could choose their guardian who would still have to be approved by the Court.

HENRY RITTENHOUSE, age 55, along with his brother DAVID, age 53, and their sisters, MARY, age 60 and EMMA, age 51, took over the operation of this huge farm after their mother ANNA had died prior to 1920. It was located south of Trappe and on the border of Upper Providence and Limerick Townships. I don't know whether the property was transferred by a deed or will but as HENRY was the eldest son he may have received it in his father's or mother's will. It is obvious these 4 children of DAVID and ANN had never married. Found in Montgomery County 1920 census Roll 1605 Book 2 Page 124.

HENRY RITTENHOUSE was operating this farm as a dairy farm in Upper Providence Township, Montgomery County, Pa. He never married and in 1930 was still living on the farm with his brother DAVID and sisters MARY and EMMA. Montgomery County 1930 census Roll 2085 Book 1 Page 191.

HENRY died Intestate on 22 January 1939. He had never married and so his brother DAVID RITTENHOUSE was appointed Administrator of the estate. It was quite extensive as he had investments in stocks, bonds and mortgages. These amounted to $11,757.07. There were debts and expenses to be deducted of $1,695.66. His sisters MARY and EMMA as well as brother DAVID, all lived in Royersford. Montgomery County, Pa. His brother JACOB lived at 1104 Greene Street in Philadelphia. His niece HELEN LASLO, daughter of deceased brother SAMUEL lived at 4690 San Andrea Ave. Los Angeles, California. They each received $1,737.91

The Administration file is RW #56,352 and the Orphan's Court file is OC #45,877. Both files are held by the Montgomery County Archives in Norristown, Pa.

vi.  DAVID C. (#26834) was born in U. Prov. Twp, Montgomery Co. PA 1867. DAVID died 19 December 1954 in U. Prov. Twp, Montgomery Co. PA, at age 87.

DAVID RITTENHOUSE was a dairy farmer in Upper Providence Township, Montgomery County, Pa. He never married and in 1930 was living on the farm with his brother HENRY and sisters MARY and EMMA. Montgomery County 1930 Census Roll 2085 Book 1 Page 191.

DAVID RITTENHOUSE wrote a very simple Will on 18 April 1940. The Will in the Montgomery County Archives does not show that it was ever witnessed. Some of the legatees were already dead by the time DAVID died on 19 December 1954. The heirs still living seemed able to agree on DAVID's wishes so it was never challenged in Court. He stipulated that his nephew DAVID C. RITTENHOUSE was to receive the farm and house. The farm consisted of 90 acres in Upper Providence Township, Montgomery County Pa. By the time DAVID died he had already deeded the farm and house to his nephew DAVID C. RITTENHOUSE and his wife EDNA E. whose last name we don't know. This deed is dated 2 July 1854, 6 months before DAVID died.

DAVID's niece, MARY L. RITTENHOUSE, married to an Unknown Robinson, and daughter of DAVID's brother JACOB RITTENHOUSE, was to receive $1,000. ANNIE M. RITTNHOUSE, another daughter of JACOB, and married to an Unknown Parker, was to receive $1,000. HELEN R. RITTENHOUSE, a niece married to an Unknown Laslo and daughter of SAMUEL, another brother of DAVID was to receive $1,000. Brother JACOB was bequeathed $500. The Mennonite Church at Yerkes. Pa. was to receive $300 for the upkeep of the family burial plot. The remainder of the estate was to be divided equally among two sisters EMMA and MARY and the nephew DAVID who had received the house and farm. DAVID appointed his sister EMMA and his nephew DAVID C. as Executors of the estate.

By the time DAVID died and the Executors were administering the estate, both sisters EMMA and MARY had died so DAVID C. was the sole Administrator appointed by the Court. As required by law, he advertised the estate settlement. In this case the ads were put into the Montgomery County Law Reporter on 24 February 1957 and into the Norristown times Herald on the 8th, 15th and 22 of February 1955.The estate DAVID left was very large. He had never married and had run a very profitable dairy farm. The farm was appraised at $20,000 but of course this had already been deeded over to DAVID C. At the time DAVID died he was holding $62,491.87 in investments such as stocks, bonds, mortgages and notes. The nieces who were to receive $1,000 each received $850 net by the time Inheritance Tax was deducted. They even taxed the $300 going to the Mennonite Church so they only received a net of $255. The nephew DAVID C. RITTENHOUSE was the huge beneficiary of this Will because his two aunts had predeceased. He received a net of $38,580.28 AFTER the tax was deducted and of course he had already received the house and farm

The Will is file RW #79,350 and the Orphan's Court file is OC #56,52. Both files are held by the Montgomery County Archives in Norristown. Pa.

vii.  EMMA (#25219) was born in U. Prov. Twp, Montgomery Co. PA 1868. EMMA died 20 March 1953 in U. Prov. Twp, Montgomery Co. PA, at age 84.

EMMA RITTENHOUSE was living on a dairy farm in Upper Providence Township, Montgomery County, Pa. She had never married and in 1930 was living on the farm with her brothers DAVID and HENRY and sister MARY. Montgomery County 1930 Census Roll 2085 Book 1 Page 191.

On 29 May 1941 EMMA, still not married, must have been seriously ill as she wrote a very short Will as follows. "This is will of Emma Rittenhouse. I will to my brother David Rittenhouse all of my little possessions and to see for sister Mary." Signed Emma Rittenhouse. I think she wrote this hurried will at a time when she expected to die soon, However she didn't die until 20 March 1953.

By this date both brother HENRY and sister MARY had died. Her brother DAVID RITTENHOUSE was appointed Administrator of the Will. He filed a personal goods inventory on 29 June 1954 amounting to $422.50. But EMMA had a half interest in the 90 acre farm where she had been living with her brother DAVID It was appraised at $10,000. Of course DAVID was the sole legatee and he already owned the other half of the farm. As it turned out DAVID died less than 2 years later.

The Will file is RW # 76,755 and the Orphan's Court file is OC # 55,502 and they are both held by the Montgomery County Archives in Norristown, Pa.

                            Obituary of EZRA RITTENHOUSE

Taken from the Gospel Herald July 1928

Rittenhouse. - Ezra Rittenhouse was born in Lincoln Co., Ont., Feb. 5, 1849. In early life he moved with his parents to Haldimand Co., where he resided until of age, when he returned to Lincoln Co. Here he was employed for some years. In 1875 he was united in marriage to Salome, daughter of Jacob and Susan Kratz (deceased). They resided on the Bishop Tilman Moyer farm for nearly thirty years where now is located the village of Vineland. In 1925 they celebrated with their friends the happy occasion of the fiftieth anniversary of their wedded life. Seven weeks previous to his death, which occurred on July 12 Sister Rittenhouse passed away very unexpectedly. His death was due to a paralytic stroke to which he succumbed in the course of thirty-six hours. After his conversion during the first series of meetings held in this district, Bro. Rittenhouse was active in the work of the Sunday school and Church for many years. His was interested in and supported the mission and educational work of the Church. His presence and fellowship will be missed, but we believe that the two lives which were so soon and so recently removed from us are united in the eternal fellowship which is promised those whose faith and trust was in our blessed Redeemer, Jesus Christ. Funeral services were held July 14, conducted by Bro. C. F. Derstine. Texts, I Cor. 15:17; Acts 1:3. Burial in the Vineland Cemetery.

ENOCH RITTENHOUSE was 29 in 1850 and was farming in Briar Creek, Township, Columbia County, Pa. His wife was CATHARINE KETCHEN who was 25. They evidently did not own the farm as there was no assessment. Their children were ALEM B. 5 and SAMANTHA J. 3. Shown in the Columbia County, Pa. 1850 census Roll 769 Book 1 Page 148.

In 1860 ENOCH RITTENHOUSE, age 39 and his wife CATHERINE KETCHEN, age 35, were farming in Black Creek Township, Columbia County, Pa. This was one of those census where they only showed an initial for the wife and children's names but I was finally able to pin this down to this ENOCH. Shown in the Columbia County, Pa. 1860 census Roll 1098 Book 1 Page 577.

By 1870 ENOCH, age 49 and his wife CATHARINE had purchased their farm and it was valued at $10,000 and personal goods were valued at $700. Their older children had evidently gone out on their own and only MARK 15 was living at home. Shown in the Columbia County, Pa. 1870 census Roll 1329 Book 1 Page 83.
